These terms apply to your use of this website and to any services supplied by Red Kite Search ("we", "us"). By using the site, you agree to them.

1. Our services

We provide SEO and AI Search consulting and related services. The scope, deliverables, fees and timelines for each engagement are set out in a written proposal or services agreement. If it conflicts with these terms, the signed agreement prevails.

2. No guarantee of results

Search engines and AI assistants are controlled by third parties and change constantly. We apply our expertise with reasonable skill and care, but we cannot guarantee specific rankings, traffic, citations or revenue. Any figures on this website are illustrative.

3. Fees and payment

Fees are as stated in your agreement. Unless agreed otherwise, invoices are payable within 14 days. We may charge interest on late payments and suspend services while an invoice is overdue. Fees exclude applicable taxes and third-party costs such as tools or content licences.

4. Client responsibilities

You agree to give us timely access, information and approvals we reasonably need, and confirm you have the right to give us access to your websites and accounts. Delays on your side may affect timelines and results.

5. Intellectual property

On full payment, you own the final deliverables created specifically for you. We keep ownership of our pre-existing materials, methods, templates and tools, and grant you a licence to use them as part of the deliverables. All content on this website belongs to us or our licensors and may not be copied without permission.

6. Confidentiality

Each party will keep the other's non-public business information confidential and use it only for the purposes of the engagement, except where disclosure is required by law.

7. Data protection

We handle personal data as described in our Privacy Policy. Where we process personal data on your behalf, we will agree a data processing agreement on request.

8. Use of this website

You agree not to misuse the site, attempt unauthorised access, introduce malicious code or use it unlawfully. The site content is provided "as is" for general information and is not professional advice.

9. Limitation of liability

Nothing in these terms limits liability that cannot be limited by law, including for fraud or death or personal injury caused by negligence. Subject to that, we are not liable for indirect or consequential loss, or loss of profit, revenue or data, and our total liability for any claim relating to a service is limited to the fees you paid us for that service in the 12 months before the claim.

10. Term and termination

Either party may end an engagement with the notice period in the agreement (30 days if none is stated). You will pay for work done up to the termination date. Clauses that by nature should survive termination will do so.

11. Changes

We may update these terms from time to time. Updates to the website terms apply from the date posted. Changes to service terms require your agreement.

12. Governing law

These terms are governed by the laws of the State of Delaware, USA, and the state and federal courts located in Delaware have exclusive jurisdiction, subject to any mandatory consumer rights.
